Welcome to Gobi! These Terms and Conditions govern your use of our transport and logistics marketplace, accessible at gobi.rw. Gobi operates as a website (accessible via browser and as a Progressive Web App - PWA) that connects users with delivery and ride service providers, as well as logistics providers. By accessing or using our platform, you agree to comply with these terms. If you do not agree with any part of these terms, please do not use Gobi.
2. Definitions
- "Platform" refers to Gobi, which operates solely as a website and can be used as a PWA (Progressive Web App).
- "User" refers to any individual or business using Gobi.
- "Service Provider" refers to ride service providers, delivery service providers, and logistics companies offering services on Gobi.
- "Client" refers to businesses or individuals requesting rides, deliveries, or logistics services.
- "Booking" refers to a confirmed transaction between a client and a service provider.
3. User Responsibilities
- Users must provide accurate information when registering and using the platform.
- Users must comply with local laws and regulations when engaging in ride-sharing, delivery, or logistics services.
- Users are responsible for maintaining the confidentiality of their accounts.
4. Booking & Payments
- Booking and payment processes differ between logistics services and ride/delivery services:
- Logistics services: Gobi uses a bidding system where businesses or C&F agents can receive quotes from logistics providers before confirming a booking. Payments can be handled either through Gobi’s wallet system or directly between the client and provider.
- Ride and delivery services: These operate with instant pricing and booking, where clients pay via the wallet system before confirming a ride or delivery request.
- Service providers will receive payments after completing the requested service, based on the payment method chosen by the client.
- Gobi may charge a service fee for transactions completed on the platform.
5. Cancellations & Refunds
- Clients can cancel bookings before service commencement, but cancellation fees may apply.
- Service providers may cancel a booking only in unavoidable circumstances.
- Refund policies depend on the nature of the service and will be determined on a case-by-case basis.
- In case of disputes, Gobi will mediate, but final decisions rest with the concerned parties.
6. Liability & Disclaimers
- Gobi acts only as a marketplace and is not responsible for service execution.
- Gobi does not guarantee the performance, reliability, or availability of any service provider.
- Users acknowledge that any disputes between clients and service providers must be resolved between them, with Gobi only offering mediation.
- Gobi is not liable for damages, losses, or delays resulting from services booked on the platform.
7. Governing Law & Dispute Resolution
- These Terms & Conditions are governed by the laws of Rwanda.
- Any disputes will first be resolved through mediation facilitated by Gobi.
- If mediation fails, disputes will be settled in Rwandan courts.
8. Amendments & Updates
- Gobi reserves the right to modify these Terms & Conditions at any time.
- Users will be notified of major updates, and continued use of the platform constitutes acceptance of the revised terms.
